Terms of Service
The agreement between you and [LEGAL ENTITY NAME] when you use HypeLoves.
src/content/legal.ts and have a lawyer review the text before treating it as binding.1. Who this is between
These terms are between [LEGAL ENTITY NAME] ("we", "us") and you, whether you hold an artist account or you are a fan using a page built with HypeLoves. Using the service means you accept them. If you are agreeing on behalf of a company or label, you confirm you may bind it.
2. Accounts
- You must be at least 13, and old enough to form a contract where you live.
- Keep your sign-in secure; you are responsible for what happens under your account.
- One person or entity per account. Do not share credentials.
3. Your content, and the rights you need to have
You keep ownership of everything you upload — audio, artwork, copy. You grant us only the licence needed to host it, transcode it, show it on your pages and deliver it to the fans you send there.
You must hold the rights to what you distribute. Remixes, edits, bootlegs and covers of other people's recordings generally require permission from the rights holders. Publishing them through HypeLoves does not grant that permission and does not shift the risk to us. If a rights holder objects, see the DMCA & takedown page.
4. What you may not do
- Upload content you do not have the rights to distribute.
- Buy, sell or exchange fake follows, likes, reposts, streams or e-mail addresses.
- Use the fan-action features to abuse, spam or mislead people, or to violate SoundCloud's, Spotify's or any other platform's terms.
- Send commercial e-mail to people who did not consent to it (see §6).
- Upload malware, or use the service to attack, scrape or overload any system.
- Resell or white-label the service beyond the features we explicitly offer.
We can suspend or close an account that breaks these rules, and will tell you why where we can.
5. Third-party platforms
Connecting SoundCloud or Spotify authorises us to perform the specific actions you configure on your behalf. Those platforms set their own rules and rate limits, can change or withdraw their APIs, and can restrict accounts. We cannot guarantee any action will succeed, and we are not responsible for what a platform does to your account.
6. Fan data and e-mail — your obligations as controller
E-mail addresses and fan records collected through your pages are yours, and you are the data controller for them. We process them on your instructions. In exchange you agree that:
- You will obtain marketing consent separately from the download — access to a file is not consent to a mailing list.
- For recipients in Türkiye you will register consents with İYS and comply with Law No. 6563 on commercial electronic messages.
- You will honour unsubscribe requests and data-subject requests, and you will name your own data practices where the law requires it.
- You will not import addresses collected elsewhere without a lawful basis for mailing them.
If a regulator or a fan brings a claim because you ignored the above, you are responsible for it.
7. Plans, payment and refunds
- Paid plans bill in advance through Polar and renew automatically until cancelled.
- Cancel any time; access continues to the end of the paid period and we do not pro-rate the remainder.
- Prices can change with notice before your next renewal.
- Statutory withdrawal rights for consumers apply where the law gives them.
8. Availability
We work to keep HypeLoves running but do not promise uninterrupted service. We may change, pause or retire features. Where a change materially reduces what a paid plan offers, we will give notice.
9. Our liability
The service is provided "as is". To the extent the law allows, we are not liable for lost profits, lost fans, lost data or indirect damage, and our total liability in any 12-month period is limited to what you paid us in that period. Nothing here limits liability that cannot lawfully be limited.
10. Ending the agreement
You can delete your account at any time from settings, which removes your campaigns and uploaded files. We can suspend or end an account for a serious or repeated breach, or where we must for legal reasons.
11. Changes to these terms
We will post updates here and change the date at the top. Material changes are announced by e-mail to account holders. Continuing to use the service after a change means you accept it.
12. Governing law
These terms are governed by the laws of Türkiye and the courts of [Istanbul, Türkiye] have jurisdiction, except where consumer-protection law gives you the right to sue where you live. The English version governs if a translation disagrees with it.
